Terms of Use

These Terms of Use (hereinafter referred to as "these Terms") set forth the conditions for the use of the services (hereinafter referred to as "the Services") provided by Gateway Arch Co., Ltd. (hereinafter referred to as "the Company") through its online store (hereinafter referred to as "the Store").
Customers who use the Services (hereinafter referred to as "the Customers") are deemed to have agreed to these Terms.

Article 1 (Scope of Application)

These Terms apply to all relationships regarding the use of the Services between the Company and the Customers.
The Company may establish individual provisions or rules regarding the Services (hereinafter referred to as "Individual Provisions") as necessary, and these shall also constitute a part of these Terms.

Article 2 (Conditions of Use)

1. Customers must comply with these Terms and relevant laws and regulations when using the Services.

2. If a minor uses the Services, they must do so with the consent of their guardian.

Article 3 (Establishment and Cancellation of Orders)

1. When a Customer places an order for a product in the Store and the Company sends a notification confirming the order (including automated reply emails), a sales contract shall be established between the Company and the Customer.

2. The Company may cancel all or part of the order in the following cases:

   • If the product is out of stock

   • If there is an obvious error in product information or pricing

   • If the payment was not completed successfully

   • If it is reasonably judged to be a fraudulent order or for resale purposes

   • If the Company determines that fulfilling the order is inappropriate for any other reason

Article 4 (Payment)

The payment methods for the price and shipping costs in the Store are limited to those specified by the Company (such as credit card, electronic payment, bank transfer, etc.).
Depending on the payment method, additional fees may apply.

Article 5 (Delivery)

1. Product delivery will be carried out by the Company or a delivery service designated by the Company.

2. The scheduled delivery date and time are estimates and may be delayed due to weather, traffic conditions, etc.

3. Delivery is limited to within Japan (overseas delivery is generally not supported).

Article 6 (Returns, Exchanges, and Cancellations)

1. Returns, exchanges, and cancellations due to Customer convenience will only be accepted if the product is unused, unopened, and the request is made within 7 days of arrival (shipping costs and fees will be borne by the Customer).

2. If there is an initial defect or incorrect delivery of the product, please contact us within 7 days of arrival. We will promptly exchange or refund at our expense.

3. Some products, such as made-to-order items, are not eligible for returns or exchanges.

Article 7 (Prohibited Acts)

Customers must not engage in any of the following acts:

• Acts that violate laws or public order and morals

• Acts that infringe on the rights or interests of others

• Acts of registering or providing false information

• Acts of unauthorized access or interference with the system

• Acts that significantly hinder the operation of the Services

• Any other acts deemed inappropriate by the Company

Article 8 (Intellectual Property Rights)

All information published on the Store (images, text, logos, product information, etc.) is owned by the Company or third parties who hold the rights.
Customers are prohibited from reproducing, reprinting, repurposing, or selling these without the Company's permission.

Article 9 (Suspension, Change, and Termination of Services)

The Company may suspend, change, or terminate all or part of the Services without prior notice to Customers in any of the following cases:

• When performing system maintenance, inspection, or updates

• When operations become difficult due to fire, power outages, natural disasters, or other force majeure

• When the Company deems it unavoidable for any other reason

Even if Customers suffer damages as a result, the Company shall not be liable for any responsibility.

Article 10 (Disclaimer)

The Company does not guarantee the accuracy, completeness, usefulness, safety, etc. of the Services and the information/products provided, whether express or implied.
The Company shall not be liable for any damages arising from the Customer's use of the Services unless the Company has intentional or gross negligence, and even if liable, the Company's liability shall be limited to the amount received from the Customer (excluding the scope protected by the Consumer Contract Act).

Article 11 (Indemnification)

If any damage, loss, or cost (including reasonable attorney fees) occurs to the Company or its affiliates due to a violation of these Terms or infringement of third-party rights by the Customer, the Customer shall indemnify and hold the Company harmless.

Article 12 (Severability)

If any provision of these Terms is judged to be invalid or unenforceable, it shall not affect the validity of the other provisions.

Article 13 (Duration and Termination)

1. These Terms shall remain in effect unless either the Customer or the Company terminates them.

2. If the Company determines that the Customer has violated these Terms, it may suspend the provision of the Services and terminate the contract without any notice.

Article 14 (Entire Agreement)

These Terms constitute the entire agreement regarding the use of the Services between the Customer and the Company and shall take precedence over any prior agreements, whether oral or written.

Article 15 (Governing Law and Jurisdiction)

These Terms shall be governed by Japanese law, and the United Nations Convention on Contracts for the International Sale of Goods shall not apply.
For disputes arising in connection with the Services, the Tokyo District Court shall be the exclusive court of first instance.

Article 16 (Amendment of Terms)

The Company may change these Terms as deemed necessary. The amended content shall take effect at the time it is displayed on this website, and if the Services are used thereafter, it shall be deemed that the changes have been agreed to.
